• Sole custody: In this arrangement, one parent is granted full responsibility for the child’s care, and the other parent may be given visitation rights.

• Shared custody: Also known as joint custody, this is where the child spends time living with both parents. Time is usually divided to reflect the best interests of the child, but it doesn’t necessarily mean an equal split.

The role of family lawyers in custody negotiations and mediation

Family lawyers play a critical role in the early stages of a custody dispute, helping to negotiate between parents and avoid going to court whenever possible. Lawyers will work with both parties to set terms that are fair, keeping the child’s best interests at the forefront. In many cases, family lawyers can help resolve disputes through mediation, a process that encourages communication and cooperation.

Mediation can be quicker, less stressful and cheaper than going to court. It’s also encouraged by the family courts, which usually expect separating parents to attend a Mediation Information and Assessment Meeting (MIAM) before starting any legal proceedings. A family lawyer will often advise their client on whether mediation is suitable and help them prepare for it, ensuring they have the necessary information and understand what’s involved.

Mediation isn’t always successful, and sometimes parents can’t reach an agreement. In these cases, a family lawyer can guide you through the next steps, including applying for a court order.

How family lawyers represent clients in court

If a custody dispute reaches court, a family lawyer will play a vital role in representing their client’s interests. 

The first step in court proceedings is usually to apply for a Child Arrangements Order, which decides where the child will live and how they will spend time with each parent. This process can be complex, and family lawyers ensure their client understands what’s involved and what evidence or information they need to provide.

In court, the lawyer will present evidence, advocate for their client and argue their case based on the child’s best interests. This might include providing reports from social workers, psychologists or other experts to demonstrate why a particular arrangement is best for the child. It’s important to note that the court’s priority is always the welfare of the child, and family lawyers will ensure their client’s case aligns with this.
